1. Acceptance of Terms

By accessing or using Kitaab (the "Service"), including the web application at kitaab.app and the Kitaab Pro Chrome Extension, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Kitaab. By clicking "I Agree," creating an account, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Kitaab provides tools for Amazon KDP authors to calculate estimated royalties, analyze pricing strategies, and research book profitability. The Service includes:

• •Kitaab Planner: Free web-based profit calculator with no account required
• •Kitaab Pro Free: Free Chrome extension with basic catalog insights (BSR, niche score, format detection)
• •Kitaab Pro: Premium Chrome extension with advanced profit analysis, break-even ACOS calculator, and pricing simulator ($97 lifetime license)

3. User Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements.

4. User Obligations and Prohibited Conduct

By using the Service, you agree to:

• •Use the Service only for lawful purposes and in accordance with these Terms
• •Not attempt to reverse engineer, decompile, disassemble, or extract source code from the Service
• •Not share, resell, sublicense, or commercially exploit your Kitaab Pro license
• •Comply with Amazon's Terms of Service when using data scraped from Amazon pages
• •Not use the Service to engage in any fraudulent, illegal, or harmful activity
• •Not interfere with or disrupt the Service or servers/networks connected to the Service
• •Not use automated systems (bots, scrapers) to access the Service without our prior written permission

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Kitaab and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to: (a) resell or commercial use of the Service, (b) collection and use of product listings or descriptions, (c) derivative use of the Service or its contents, or (d) any use of data mining, robots, or similar data gathering tools.

6. Kitaab Pro License Terms

6.1 License Grant

Upon payment of the $97 lifetime license fee, you are granted a personal, non-transferable, non-exclusive license to use Kitaab Pro for the lifetime of the service, subject to these Terms.

6.2 License Restrictions

• •One license per user (tied to your email address)
• •Non-transferable (cannot be sold, gifted, or transferred to another user)
• •For individual use only (not for commercial resale or team/agency use without separate agreement)

6.3 Updates and Support

You will have access to the core features of the Kitaab Studio and/or Extension for as long as the product is commercially supported. We intend to provide free updates, bug fixes, and new features to Lifetime License holders indefinitely. However, we reserve the right to charge for significant, optional "Add-On" modules or entirely new distinct software products developed in the future. In the unlikely event that Kitaab ceases operations, we will provide a minimum of 60 days' notice and downloadable versions of key tools where technically feasible.

Payments are processed by LemonSqueezy, a third-party payment processor. By making a purchase, you agree to LemonSqueezy's terms and privacy policy.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KITAAB, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• •Any indirect, incidental, special, consequential, or punitive damages
• •Loss of profits, revenue, data, goodwill, or business opportunities
• •Inaccuracies in calculations, estimates, or projections provided by the Service
• •Actions taken by Amazon or other third parties based on your use of the Service
• •Unauthorized access to or alteration of your transmissions or data

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR KITAAB PRO (IF APPLICABLE), OR $100 USD, WHICHEVER IS LESS.

10. Local Storage & Data Persistence

Kitaab operates as a "Local-First" application. All project data, settings, and generated content are stored locally within your browser's IndexedDB storage system. We do not store, back up, or have access to your content on our servers.

11. Third-Party Affiliates & Influencers

You may have been introduced to Kitaab through a third-party affiliate, influencer, or educator. These parties are independent marketers and are not employees or authorized representatives of Kitaab.

• •Opinions Not Endorsements: Claims, income proofs, or promises made by affiliates regarding their own success are strictly their own experiences and do not guarantee your results.
• •No Liability: Kitaab is not responsible for any misleading claims, bonus offers, or unauthorized representations made by third-party affiliates.

12. Intellectual Property & Commercial Rights

• •Your Ownership: You retain full commercial rights (copyright) to the specific output (PDFs, images, text) you generate using Kitaab, provided you have an active license at the time of generation.
• •Our Ownership: Kitaab retains all rights to the underlying software, source code, algorithms, and templates. You may sell the books you create, but you may not reverse-engineer, resell, or redistribute the software or its raw generation assets as a competing tool.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kitaab and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including Amazon's Terms of Service; or (d) any content you submit through the Service.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe:

• •Violates these Terms or applicable law
• •Is harmful to other users, us, or third parties
• •Involves fraudulent or illegal activity
• •Violates our Fair Use Policy (e.g., commercial resale of licenses)

Upon termination, your license to use the Service will immediately cease. Termination for cause (violation of Terms) does not entitle you to a refund.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights, including your right to file a lawsuit in court.

12.1 Informal Resolution

Before filing a claim, you agree to contact us at support@kitaab.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

12.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court. The arbitration will be conducted in English and held in the United States.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Kitaab individually. You waive your right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the United States, and you consent to personal jurisdiction in such courts.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, for significant changes, by email or prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Kitaab regarding the Service and supersede all prior agreements and understandings.
